This Privacy Policy explains how America First Insight ("AFI," "we," "us," or "our") collects, uses, stores, and shares information when you use americafirstinsight.com, related AFI websites, accounts, products, features, and services (collectively, the "Services").

AFI is a political news, research, polling, and commentary service. Information you voluntarily submit, interact with, or communicate to us may sometimes reveal political interests or opinions. Where applicable law requires consent or another special basis for processing sensitive information, we will process such information consistent with those requirements.

8. Your Privacy Choices and Rights
Depending on where you live, applicable law may provide rights to request access, correction, deletion, portability, restriction, or other treatment of your personal information, and may provide rights concerning certain targeted advertising, sale or sharing, profiling, or sensitive information practices.

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Some paid features or account features may be restricted to users who are at least 18 years old or who have permission from a parent or legal guardian, as applicable.

Terms & Conditions
These Terms & Conditions ("Terms") form an agreement between you and America First Insight governing access to and use of the Services.
1. Eligibility and Acceptance
You must be legally capable of entering into a binding agreement to purchase paid Services. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. You agree to provide accurate information and promptly notify us of suspected unauthorized access.
Accounts and paid memberships are intended for the authorized account holder. Unless AFI expressly permits otherwise, you may not sell, transfer, sublicense, publicly distribute, or share account access in a way that allows others to avoid obtaining their own required access.
3. Paid Memberships and Subscriptions
Certain features, data, downloads, articles, tools, memberships, or other content may require payment. Prices, billing periods, included features, and any applicable taxes are shown at or before checkout.
Automatic renewal
If a subscription is presented as automatically renewing, you authorize us and our payment processor to charge the applicable recurring subscription price and taxes to your payment method at each renewal until you cancel, subject to applicable law.
Cancellation
You may cancel an automatically renewing subscription through the cancellation method made available by AFI or by contacting us. Unless applicable law requires otherwise, cancellation stops future renewals and does not retroactively cancel, refund, or prorate the current paid billing period. Access may continue through the end of that period.
Lifetime or non-recurring access
A "lifetime" purchase, if offered, means access for the lifetime of the applicable AFI product or service, not the purchaser's biological lifetime and not a guarantee that any particular feature, website, product, or service will operate indefinitely. AFI may modify, replace, or discontinue features as described in these Terms.
4. Payments
You authorize AFI and its payment providers to charge amounts disclosed at checkout. You are responsible for applicable taxes and for keeping payment information current. We may suspend paid access if a charge fails, is reversed, disputed, or remains unpaid.
Purchases are subject to the Refund Policy below. Initiating an improper or fraudulent chargeback does not eliminate amounts legitimately owed and may result in suspension or termination of access, subject to applicable law.
5. AFI Content, Polling, Data, and Intellectual Property
Unless otherwise stated, the Services and their original content, design, branding, graphics, articles, ratings, scorecards, polling presentations, databases, compilations, software, forecasts, downloadable materials, and other AFI-created material are owned by or licensed to AFI and are protected by applicable intellectual-property laws.
Subject to these Terms, AFI grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal or internal lawful use. This license does not transfer ownership.
Without written permission, you may not:
- Republish, resell, sublicense, scrape, mirror, or systematically redistribute substantial portions of paid or proprietary AFI content or data.
- Use automated means to bypass paywalls, access controls, rate limits, or other technical restrictions.
- Remove copyright, trademark, attribution, or proprietary notices.
- Misrepresent AFI data, graphics, endorsements, forecasts, or ratings as your own work or as an official statement different from what AFI published.
- Use the Services to build or populate a competing database or commercial product by systematically extracting AFI-proprietary material.
Reasonable quotation, linking, commentary, criticism, and other uses permitted by law are not prohibited by this section.
6. Election Forecasts, Polling, Ratings, and Commentary
AFI provides political analysis, journalism, polling aggregation, forecasts, ratings, scorecards, election data, and commentary for informational purposes. Elections, polling, turnout, vote counting, candidate status, and other political events are inherently uncertain and may change rapidly.
Forecasts, probabilities, ratings, projections, polling averages, live results, estimated margins, and similar materials are estimates and opinions, not guarantees of an election outcome or future event. Data may contain delays, errors, incomplete reporting, revisions, or information supplied by third parties.
Nothing in the Services is legal, financial, investment, tax, or professional advice.
7. Acceptable Use
You agree not to:
- Use the Services unlawfully or to violate the rights of others.
- Attempt to gain unauthorized access to accounts, systems, databases, or restricted areas.
- Interfere with, overload, damage, reverse engineer where prohibited, or disrupt the Services.
- Transmit malware or malicious code.
- Use bots, scripts, scraping systems, or other automation in a manner that materially burdens the Services or circumvents access controls.
- Impersonate another person or misrepresent your affiliation with AFI.
8. Third-Party Content and Links
The Services may include information, embeds, advertisements, links, data, or services supplied by third parties. AFI does not control and is not responsible for third-party websites, services, accuracy, availability, security, or privacy practices. Your dealings with third parties are between you and those parties.
9. User Submissions
If you voluntarily submit content for publication or use by AFI, you represent that you have the necessary rights to submit it and that it does not violate law or third-party rights. Any separate contributor, licensing, or submission agreement controls if it conflicts with this section.
10. Suspension and Termination
AFI may suspend, restrict, or terminate access when reasonably necessary to address violations of these Terms, nonpayment, fraud, abuse, security risks, legal requirements, or threats to the Services or other users. Where appropriate and practical, we may provide notice or an opportunity to resolve the issue.
Termination for violation of these Terms does not create a right to a refund except where required by applicable law.
11. Service Changes and Availability
We may add, remove, modify, suspend, or discontinue features, content, data sources, pricing, or portions of the Services. We do not guarantee uninterrupted or error-free availability. For automatically renewing paid plans, material pricing changes will apply as permitted by law and with any notice required by law.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." AFI DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. AFI DOES NOT WARRANT THAT THE SERVICES OR ANY DATA, FORECAST, POLL, RESULT, RATING, ARTICLE, OR OTHER CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, OR UNINTERRUPTED.
Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFI AND ITS OWNERS, CONTRIBUTORS, CONTRACTORS, SERVICE PROVIDERS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM OR RELATING TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFI'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO PAID SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO AFI FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
These limitations do not apply where prohibited by law.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless AFI and its owners, affiliates, contractors, contributors, and representatives from claims, liabilities, losses, and reasonable costs arising from your unlawful misuse of the Services, your material violation of these Terms, or your infringement of another person's rights.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent another jurisdiction's law must apply. Any dispute not subject to a separate enforceable dispute-resolution agreement may be brought in a court having lawful jurisdiction in Florida, subject to applicable consumer-protection law.
16. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted with a revised "Last updated" date. If required by law, we will provide additional notice of material changes. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.
17. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver. These Terms, together with incorporated policies and any applicable purchase-specific terms, constitute the agreement concerning the Services addressed here.

Refund Policy
This Refund Policy applies to purchases made directly from America First Insight unless a different written policy is expressly presented for a specific product or transaction.
1. No Refunds
Except where required by applicable law, AFI does not provide refunds, prorated refunds, credits, or exchanges for membership fees, subscription payments, annual plans, lifetime or non-recurring access, digital products, donations or support payments where applicable, downloadable content, early-access content, data access, or other paid Services after a purchase is completed.
A user's failure to use a paid Service, change of mind, dissatisfaction with political analysis or editorial content, disagreement with a rating, forecast, endorsement, scorecard, polling result, or other AFI opinion, or failure to cancel before a renewal date does not by itself create a right to a refund.
2. Subscription Cancellation
Canceling a recurring subscription prevents future renewals once the cancellation becomes effective. Unless applicable law requires otherwise, cancellation does not refund or prorate any part of the current billing period. You may continue to receive the applicable paid access through the end of the paid period, unless access is terminated for violation of the Terms & Conditions or another lawful reason.
3. Annual Plans
Annual plans are charged for the full stated term. Except where required by law, canceling during an annual term does not entitle you to a refund for unused months or days. Cancellation instead prevents the next automatic renewal, if the plan is set to renew automatically.
4. Lifetime and Non-Recurring Purchases
Lifetime, one-time, or other non-recurring purchases are final and non-refundable except where required by law. "Lifetime" refers to the lifetime of the applicable AFI product or service as described in the Terms & Conditions and is not a guarantee that a particular product, feature, or service will exist indefinitely.
5. Digital Content and Downloads
Because digital content, premium data, downloads, early-access materials, and similar benefits may be delivered or made available immediately, purchases granting such access are final and non-refundable except where applicable law requires otherwise.
6. Duplicate or Erroneous Charges
If you believe AFI charged you more than once for the same transaction, charged an incorrect amount, or charged you because of a verifiable billing error, contact us promptly. AFI may investigate and, when appropriate, reverse an erroneous or duplicate charge. Correcting a billing error is not a waiver of this Refund Policy.
7. Exceptional Circumstances
AFI may, in its sole discretion, issue a refund, partial refund, or account credit in an exceptional circumstance. A discretionary refund or credit in one instance does not create an obligation to provide the same remedy in another instance and does not modify this Policy.
8. Chargebacks and Payment Disputes
If you believe a charge is incorrect, we encourage you to contact AFI before initiating a payment dispute so we can review the transaction. AFI may suspend or restrict accounts associated with fraudulent, abusive, or demonstrably improper chargebacks, subject to applicable law and payment-network rules.
Nothing in this section limits any non-waivable right you have under applicable law or the rules governing your payment method.
9. Where Law Requires a Refund
Nothing in this Refund Policy eliminates rights that cannot lawfully be waived. If applicable law requires AFI to provide a refund, cancellation right, rescission period, or other remedy in a particular circumstance, AFI will comply with that requirement.
